The Petitioner has filed the present petition, assailing closure direction dated 09th September, 2024 issued by Respondent No. 1/ Delhi Pollution Control Committee & Anr.

It is noted that the impugned closure directions refer to the inspection of M/s Creative Mann, a unit which was conducting its operations from property bearing No. B-64, IInd and IIIrd Floor, Lawrence Road Industrial Area, New Delhi - 110035.

Mr. Himanshu Bhushan, counsel for the Petitioner, states that the Petitioner is running a unit under the name of M/s Colormann, which is distinct from M/s Creative Mann, although both units are operating from the same premises. He argues that the impugned order is unsustainable as there was no prior show cause notice.

Considering the above, Mr. Kush Sharma, counsel for Respondent No. 1, on instructions, states that the Respondent No. 1 is willing to reexamine Petitioner's contentions. 5.

In light of the above, the closure directions dated 9th September, 2024, are set aside. The Respondent No. 1 is permitted to issue a fresh show cause notice to the Petitioner, if so required, within a period of six weeks from today.

The Petitioner shall be permitted to give an appropriate response thereto, which shall then be considered by Respondent No. 1 afresh, and the decision shall be taken thereon, in accordance with law. 7.

With the above directions, the present petition is disposed of along with pending applications.
