% 16.08.2016 IA No.8537/2016 (of both the defendants for transfer of the suit) 1.

Notice of the application was ordered to be issued to the plaintiffs as well as the counsel appearing for them.

Both the plaintiffs are reported to have been served but none appears on their behalf.

The suit is for declaration of the sale deed in respect of first floor portion and a shop at the ground floor of property no.36/2, Ashok Nagar, Tihar-II, New Delhi as void and for partition of property no. 36/2, Ashok Nagar, Tihar-II, New Delhi.

As per para 16 of the plaint, the valuation of the suit for the purpose of declaration is Rs.1,50,000/- and the valuation of the suit for the relief of partition is Rs.70,00,000/-.

The counsel for the defendants is correct in his contention that as per the Office Order dated 24th November, 2015 of Hon'ble the Chief Justice in exercise of powers under Section 4 of the Delhi High Court (Amendment) Act, 2015, this suit is liable to be transferred. CS(OS) 916/2008

The property no.36/2, Ashok Nagar, Tihar-II, New Delhi is stated by the counsel for the defendants to be falling within the West District, Tis Hazari Courts, Delhi.

The Court Master also confirms so.

Accordingly, the suit is transferred to the Court of District Judge, West, Tis Hazari Courts, Delhi.
