The present petition is filed by the petitioners seeking quashing of FIR No. 373/2018 dated 30.04.2018, registered at Police Station Samaipur Badli for the offences under Sections 451/506/427/34 of the Indian Penal Code, 1860 ('IPC') and all the consequential proceedings arising therefrom. 2.

The FIR was registered on allegations made by the complainant in regard to harassment by the petitioners and other accused persons.

It is the case of the petitioners that they along with their children were playing cricket in a park near their residence and when their ball dropped in front of the house of the complainant, she got violent and started abusing. It is alleged that she has also given beatings to a child. The petitioners claim that they approached the police, however, no action was taken against the complainant. The petitioners also claim to have submitted the video clip to the police which clearly shows that it was essentially respondent no.3/complainant who was at fault.

Undisputedly, the FIR was registered on 30.04.2018 and the chargesheet was also filed way back in the year 2019. On being asked, it is informed that the matter is pending consideration for arguments on charge before the learned Trial Court and is not being heard for some reasons or the other. 6.

Considering that the investigation has already been completed and the chargesheet was also filed long back in the year 2019, this Court does not consider it apposite to entertain the present petition.

The petitioners are at liberty to take all the arguments before the learned Trial Court at the time of consideration of arguments on charge.

However, considering that the chargesheet was filed long back in the year 2019, the learned Trial Court is directed to expedite hearing of arguments on charge.

The petition stands disposed of with the aforesaid observations. Pending applications also stand disposed of. 10.

Needless to state that the petitioners are at liberty to approach this Court in case any grievance remains in future.
