O R D E R
% 26.10.2017 On the complaint of respondent no.2 FIR 37/2014 under Section 63 of Copy Rights Act, 1957 and under Sections 103/104 of Trade Mark Act, 1999 was registered with Economic Offence Wing. Respondent no.2 alleged in the FIR that the petitioner was making counterfeit goods under their trademark and were violating copy rights. It was alleged that copy rights in respect of its various artistic work titled as "Chhota Bheem, Kalia, Jaggu, Raju, Dholu Bholu, Princess Indu and Chutki" were violated. It is submitted that now the petitioner and respondent no.2 have settled their disputes amicably vide Memorandum of Understanding dated 17th May, 2017, therefore, aforesaid FIR and consequent proceedings emanating therefrom, may be quashed.
Mr. Lalit Mohan, AR of respondent no.2 is present in the Court and confirms that settlement has been arrived at between respondent no.2 and petitioner. It is submitted that the settlement between the parties has been arrived at of their own free will and without any undue force, pressure or coercion Keeping in mind the settlement arrived at between petitioner and respondent no.2 vide Memorandum of Understanding dated 17th May, 2017, in the interest of justice, FIR 37/2014 under Section 63 of Copy Rights Act, 1957 and under Sections 103/104 of Trade Marks Act, 1999 registered with Economic Offence Wing and the consequent proceedings emanating thereform are quashed.
Petition is disposed of in the above terms.
