% 27.02.2017 The learned counsel appearing on behalf of the respondent submits that the legal notice/representation sent by the counsel for the petitioner on 15.02.2017, a copy of which is to be found on pages 95 - 100, is under the consideration of the appropriate authority dealing with the subject tender. He also has instructions to state that unless and until the said legal notice/representation is disposed of by a speaking order, the financial bid in the subject tender shall not be opened. He also states that the decision on the said legal notice/representation shall be communicated to the petitioner immediately upon it being taken. In view of the above statements, the learned counsel for the petitioner does not press this writ petition any further. However, he seeks to reserve his liberty to file a fresh petition in case the decision goes against the petitioner. The writ petition stands dismissed as withdrawn in the aforesaid
