During the course of arguments, it was informed that the matter is listed before the Trial Court for hearing arguments on the application filed by the respondent to place on record additional documents. 2.

It is further informed that the appellant did not produce any evidence and the matter is now listed for recording evidence of the respondent. 3.

It is agreed that the respondent shall complete its evidence on two effective dates before the Trial Court.

In view of the above, learned counsel for the appellant seeks permission to withdraw the appeal.

Trial Court shall dispose of the application for placing additional documents on record on the date fixed.

Thereafter, two effective dates shall be given to the defendant / respondent to complete its entire evidence at its own responsibility on two effective dates. 6.
