After some hearing, Mr. Madhu Sudan Bhayana, learned counsel for the petitioners, states that the petitioners intend to challenge the constitutionality of Section 127(2) of the Electricity Act, 2003, to the extent that it requires the pre-deposit for hearing of an appeal under the said provision.

The writ petition, alongwith pending applications, is dismissed as withdrawn with liberty to the petitioners to file a writ petition in the aforesaid terms, on the same cause of action as agitated in this writ petition.
