% 12.05.2017 This is an application filed under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.296/2016, under Sections 420/120-B IPC, registered at P.S. North Rohini, Delhi.

Learned counsel for the petitioner submits that the petitioner has joined the investigation in the aforesaid FIR and prays that the petitioner be granted anticipatory bail.

Learned APP for the State has filed status report and submits that the petitioner is not cooperating in the investigation and is not ready to disclose the amount and also the proceedings under Section 82 Cr.P.C. has already been initiated against him. She further submits that an amount of Rs.55 lakhs has gone into the account of the petitioner, where the complainant was made guarantor and he has cheated the complainant by way of said transactions.

Looking into the facts and circumstances and the allegation levelled

against the present petitioner that the amount of Rs.55 Lakhs has been gone into the account of the petitioner, to which detailed investigation is required and also the fact that the petitioner is required for custodial interrogation as there is an allegation of non-cooperation by the petitioner, in these circumstances I do not find it a fit case to grant anticipatory bail to the petitioner. Consequently, the present bail application is dismissed and disposed of accordingly.
