Petitioner/defendant has assailed order dated 02.05.2025 of the learned trial court, whereby the learned trial court dismissed the application of petitioner/defendant for tendering certain documents through testimony of DW2, which documents were not on record as petitioner‟s request to take those documents on record had already been rejected on 08.04.2024. The order dated 08.04.2024 was never assailed by the petitioner. Admittedly, DW2 is son of the petitioner/defendant and is not a summoned official witness.

After addressing partly, learned counsel for petitioner/defendant seeks permission to withdraw this petition with liberty to institute appropriate legal proceedings in accordance with law. 3.

Accordingly, the petition and the accompanying application are dismissed as withdrawn with liberty as sought.
