Learned counsel for the respondent submits that the Trial Court has decreed the suit against the petitioner vide judgment dated 3rd May, 2018. 2.
Learned counsel for the petitioner submits that he has no instructions in the matter from the petitioner.

This Court of the view that if the petitioner chooses to challenge the judgment and decree, it would be appropriate for the petitioner to include the challenge made in this petition, in the appeal against the judgment dated 3rd May, 2018.

This petition is disposed of with liberty to the petitioner to urge the contentions raised in this petition in the appeal against the judgment dated 3rd May, 2018, if he chooses to challenge the judgment dated 3rd May, 2018. 5.
It is clarified that this Court today has not expressed any views on the merits of this case and both the parties are at liberty to urge their respective contentions in the appeal against the judgment, if preferred by the petitioner. 6.
Pending application is disposed of.
