Vide the present application, the parties jointly pray for disposing of the petition in terms of the settlement agreement entered into between the parties on 15.02.2019.

The present petition has been filed by the petitioner/Management seeking quashing of the award whereby it has been directed to reinstate the respondent with continuity of service and full backwages.

Learned counsel for the parties state that during the pendency of the present petition, the parties have arrived at an amicable settlement and have accordingly entered into a settlement agreement dated 15.02.2019, whereunder the petitioner will pay a lump sum compensation of Rs.3,62,500/- to the respondent in lieu of all its
claims.

The respondent, who appears in person, states that he has entered into a settlement out of his own free will and without any coercion. The demand draft for the agreed amount has been handed over to the respondent through counsel in Court. He also prays that the writ petition be disposed of in terms of the settlement. 5.
Accordingly, the writ petition along with the pending application is disposed of in terms of the settlement. The parties will remain bound by the terms of the settlement. Needless to state that in view of the settlement, the impugned award will no longer be enforceable.

At this stage, learned counsel for the petitioner states that since the petitioner had deposited a sum of Rs.2,71,000/- as 50% of the awarded amount directed by this Court vide order dated 06.04.2018, the said amount may also be released to the petitioner. Learned counsel for the respondent has no objection to the said request. 7.
Accordingly, the Registry is directed to forthwith release the aforesaid amount of Rs.2,71,000/- with upto date accrued interest to the petitioner.
