The present petition has been filed under Section 528 BNSS, 2023 seeking quashing of FIR No.538/2024 under Sections 110/126(2)/3(5) BNS registered at Police Station Badarpur and all consequential proceedings emanating therefrom on the ground that the parties have arrived at a settlement.

Petitioner nos.1 to 5, as well as, respondent no. 2, who are present in Court, have been identified by their respective counsels, as well as, by the Investigating Officer SI Onkar, PS. Cyber SED. The brief facts of the case are that on the intervening night of 06.07.2021 and 07.07.2021 information was received vide GD Entry No. 06A regarding a scuffle between the parties due to which the respondent no.2 had suffered simple injury in nature and further taken to hospital. The dispute between the parties also led to the registration of present FIR. 7.

During pendency of the proceedings, the parties have arrived at an oral settlement with the intervention of family and friends and have resolved all their disputes amicably without any coercion or pressure. 8.

It is also a term of the settlement that respondent no.2 will cooperate with the petitioners for the quashing of the present FIR. 9.

Respondent no.2, on a query posed by the Court, states that he has no objection in case the FIR is quashed.

In view of the fact that the parties have arrived at a settlement, no useful purpose will be served in continuing the proceedings, rather the same would create further acrimony between them.

It is, thus, in the interest of justice that the present FIR and all the other proceedings emanating therefrom be quashed. 12.

Consequently, the petition is allowed and the FIR No.538/2024 under Sections 110/126(2)/3(5) BNS registered at Police Station Badarpur alongwith all other proceedings emanating therefrom, is quashed. 13.

The petition stands disposed of in the above terms. 14.
