By the present petition, the petitioner seeks to impugn the order dated 19.11.2014 by which the application for leave to defend under Section 25-B
(4) read with Section 14(1)(e) of the DRC Act was allowed and the respondent/defendant was allowed to file written statement. 2.
On a query from the court the learned counsel for the petitioner submits that the evidence of the petitioner is complete and the matter is now fixed for 24.08.2016 for recording the evidence of the respondent. 3.
The learned counsel appearing for the respondent assures this court that only 2-3 witness are to be examined and the respondent would not take any adjournment other than in case of an emergency. 4.
In view of the above assurance given by the respondent, the learned counsel for the petitioner without prejudice to the rights and contentions of the petitioner seeks to withdraw the present petition. 5.
The present petition is dismissed as withdrawn without prejudice to RC.REV. 380/2015
the rights and contentions of the parties.
