HON'BLE MS. JUSTICE MINI PUSHKARNA

O R D E R

% 16.10.2025 CM APPL. 65264/2025 1.

The present application has been filed on behalf of the petitioner for revival of the present petition on the ground that despite the order dated 06th October, 2025 passed by this Court, wherein, it has been directed that the petitioner herein shall be given a notice, in case any application for electricity connection is filed by respondent nos. 3 or 4, an electricity connection was granted to respondent no. 4 on the same date, i.e., 06th October, 2025.

2.

Thus, it is submitted that without complying with the directions of this Court and without giving any notice to the petitioner, electricity connection was granted to respondent no. 4.

The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

3.

Per contra, learned counsel appearing for respondent nos. 1 and 2, i.e., Tata Power Delhi Distribution Limited, submits that there was some miscommunication, on account of which, the correct facts could not be brought forth before this Court.

4.

He further submits that when the fact of electricity connection having been granted to respondent no. 4 was brought to the notice of the respondent nos. 1 and 2, in compliance of the order dated 06th October, 2025 passed by this Court, a disconnection notice dated 11th October, 2025 was issued to respondent no. 4.

5.

Learned counsel appearing for respondent nos. 1 and 2 has handed over to this Court a copy of the said disconnection notice dated 11th October, 2025, which is reproduced as under:

The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

6.

Accordingly, since the electricity connection to the premises of respondent no. 4 already stands disconnected, it is directed that the respondent nos. 1 and 2 shall grant hearing to the petitioner herein and the petitioner shall be at liberty to raise any objection with regard to the grant of electricity connection to respondent no. 4.

7.

A speaking order shall be passed by the respondent nos. 1 and 2 with regard to the objections raised by the petitioner. 8.

In case, the petitioner is aggrieved by any speaking order being passed by respondent nos. 1 and 2, the petitioner shall be at liberty to seek remedies, in accordance with law.

9.

The petitioner is at liberty to request respondent nos. 1 and 2 for providing the documents, as submitted by respondent no. 4 for grant of the electricity connection.

10.

With the aforesaid directions, the present application is disposed of. MINI PUSHKARNA, J OCTOBER 16, 2025/ak The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
