versus L C GOYAL & ORS ..... Respondents Through: Mr. Ruchir Mishra and Mr. Mukesh Kr. Tewari, Advs.

CORAM:

HON'BLE MR. JUSTICE MANMOHAN

O R D E R

% 10.01.2017 In pursuance to the last order, the original file pertaining to the petitioner has been produced before this Court. A perusal of the file shows that the petitioner's claim had been forwarded to the United Nations for compensation on account of injuries suffered by her while she was on deputation with the UN Peace Keeping Force at Liberia. Along with the claim, the medical report of the Army Hospital (R&R) which showed petitioner's disability as 10 per cent was enclosed.

From the file, it is apparent that the United Nations asked for the latest medical report of the petitioner from an orthopaedic surgeon vide fax message dated 20th July, 2015.

In pursuance to the said message, a fresh medical Board was constituted which opined on 19th August, 2015 that the petitioner's

disability was nil.

Keeping in view the aforesaid facts, learned counsel for the petitioner states that he would challenge the findings of the medical board dated 19th August, 2015. Consequently, the present contempt petition is closed and the petitioner is given liberty to challenge the report of the medical board dated 19th August, 2015. This Court clarifies that it has not expressed any opinion on the merits of the controversy. Rights and contention of all the parties are left open.
