Writ Petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as „B.N.S.S.', has been filed on behalf of the Petitioners, for quashing of FIR No.448/2023 under Section 323/324/506/34 of the Indian Penal Code, 1860 (hereinafter referred to as „IPC') registered at Police Station Shahbad Dairy and all the consequential proceedings emanating therefrom, in terms of the Settlement dated 17.09.2025. 4.

The Complainant is the husband of the Petitioner No. 1 and a fight had taken place between the Complainant and the Petitioners, who are his wife and her family members.

Brief facts of the case are that the Respondent No. 2 has a money transfer shop at Khasra No.28/18, Shahbad Daulatpur, Delhi, through Atif Online Point. On 24.04.2023, someone gave the Respondent No.2 a bottle of liquor. Seeing the bottle of liquor, his wife, namely, Ms. Romina started arguing with him. During the conversation, their quarrel escalated and his wife pushed the Complainant and in anger. The Complainant also pushed his wife. They had raised hands on each other. At around 06:10 pm, Petitioner No. 1 came with her family members and started beating the Respondent No. 2 with sticks. Iqbal @ Rahul, the brother of the Respondent No. 1, took out a knife from his pant pocket and stabbed him. The knife hit the Respondent No. 2 behind his left ear. Seeing a large crowd gathering there, they all ran away and the Respondent No. 2 called the Police. 8.
On the Complaint of the Respondent No.2/Complainant, FIR No.448/2023 under Section 323/324/506/34 of IPC, got registered at Police Station Shahbad Dairy.

It is stated that the Petitioners and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at compromise-cum-settlement deed dated 17.09.2025. In the Settlement, it was inter alia settled between the parties that they have no grievances towards each other after this Settlement. It is also settled between the parties that they shall not file any claim/suit/complaint or initiate any proceedings any judicial or quasi judicial proceedings against each other. Today, the Respondent No. 2, who is present in the Court, states that he has no objection if the said FIR is quashed. 11.
The parties are present before this Court in-person today, and have been identified by their Counsel and Investigating Officer concerned and they have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement. 12.
Considering the nature of the allegations and that they have settled the matter, the FIR No. 448/2023 under Section 323/324/506/34 of IPC, registered at Police Station Shahbad and all the consequential proceedings emanating therefrom are quashed. The nature of injuries are simple. 13.
The Petition is disposed of accordingly.
