The petitioner herein seeks direction to respondents No. 2 and 3 to carry out investigation in a fair and expeditious manner on his complaint dated 03.09.2025 submitted to the SHO, Police Station Nangloi. Moreover, he also seeks a departmental enquiry to be initiated against the delinquent police officers for not carrying out the investigation on the basis of the said complaint.

Dissatisfied with the inaction on the part of official respondents, the petitioner/complainant thus is before this Court. 3.

Learned counsel for the petitioner argues that the investigating agency is not proceeding in a fair and just manner and instead of taking action against respondents no. 4 to 8, the sons of the petitioner no. 1 have been arrested in FIR No. 337/2025 and sent to judicial custody. Learned ASC appears on service of advance copy of the petition. He opposes the petition arguing that the law will take its own recourse and in case any further action is warranted the same shall be taken in accordance thereof.

Be that as it may, in my opinion, the petitioner ought to have availed other available legal remedies for redressal of his grievance before approaching this Court.

Ordinarily, in cases of grievances arising from unfair or improper investigation of a complaint, the aggrieved person can seek recourse by approaching a superior police officer as per Section 30 Bharatiya Nagarik Suraksha Sanhita, 2023. If the grievance remains unaddressed, one can then approach a Magistrate of competent jurisdiction under Section 175(3) Bharatiya Nagarik Suraksha Sanhita, 2023, who can seek submission of a report by the police. Reference may also be had to Apex Court judgment in Sakiri Vasu versus State of U.P. and Others, (2008) 2 SCC 409.

Petitioner is at liberty to take recourse to the remedy as may be advisable in accordance with law.

In the premise, instant petition is disposed of along with pending application(s), if any.
