Mr. Rohit Dutta, learned counsel appearing on behalf of the Plaintiff states that he has instructions to unconditionally withdraw the present suit since the Plaintiff has learnt that way back on 04.04.2024 the Resolution Plan vis-a-vis Defendant was accepted in the CIRP process and a new management has taken over. He states that the CIRP process of Defendant stood concluded on 04.04.2024 and since, all these events happened even prior to the institution of the suit, the Plaintiff's cause of action stands extinguished and therefore, the Plaintiff seeks liberty to withdraw the present suit.

In view of the above, he orally prays that the Court fee be refunded. 3.
In view of the aforesaid facts and considering the suit is at an initial stage, the Registry is directed to refund the 80% of the Court Fee in accordance with Rules.
