The applicant seeks regular bail in connection with FIR No. 275/2025 dated 17.05.2025, registered at Police Station Govind Puri, under Section 64(1) of the Bharatiya Nyaya Sanhita, 2023, and Section 4 of the Protection of Children from Sexual Offences Act, 2012. 2.
By order dated 15.12.2025, this Court noted that the statement of the prosecutrix was to be recorded before the Trial Court on 23.12.2025, and directed the Trial Court to ensure that her testimony was completed on that date. Mr. Aakash Dubey, learned counsel for the applicant, however, submits that the examination of the prosecutrix could not take place on 23.12.2025 as she had a school examination on that day. I am informed that the case is now listed before the Trial Court on 06.04.2026 BAIL APPLN. 3823/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. for recording of the prosecutrix's evidence.

Mr. Aashneet Singh, learned Additional Public Prosecutor, states that the only 2 public witnesses in this case are the prosecutrix and her mother.

After some hearing, Mr. Dubey seeks permission to withdraw the present application, without prejudice to the applicant's right to approach the Sessions Court after the recording of the evidence of the 2 material witnesses.

Mr. Singh and Mr. Vikas Kumar, learned counsel for the prosecutrix, also undertake that no unnecessary adjournments will be sought by the prosecutrix or her mother.

The application is accordingly dismissed as withdrawn, in terms of the above submission.

The applicant is free to approach the Trial Court for the expeditious recording of evidence, which the Trial Court may consider in accordance with its own Board and having regard to the age of matters pending before it.

It is made clear that this Court has not expressed any opinion on the merits of this matter and of any application that may be filed by the applicant, which the learned Trial Court shall consider in accordance with law.
