Mr. Rohit Dutta, learned counsel appearing on behalf of the Plaintiff states that he has instructions to withdraw the present suit, with liberty to file its claim with the IRP appointed vis-à-vis the Defendant in the CIRP. 2.

In view of the above, he orally prays that the Court fee be refunded. In view of the aforesaid facts and considering that the suit is at a nascent stage, the Registry is directed to refund the 80% of the Court Fee in accordance with Rules.

The aforesaid direction is acceptable to the Plaintiff. 4.

The suit is dismissed as withdrawn, with liberty reserved to the Plaintiff to file its claims before the IRP, in accordance with law. 5.

The pending application(s), if any, stands disposed of. 6.
