This petition has been filed seeking interim bail on medical grounds for a period of 90 days in FIR No.320/2024, P.S Special Cell, under Sections 22/29 of NDPS Act; petitioner was arrested on 14th October 2024. 2.
Counsel for petitioner states that petitioner is 75 years old and was arrested based on disclosure since he is running a pharmaceutical company alleged to have supplied tramadol tablets without invoices, which were seized from co-accused. He states that petitioner is suffering from various ailments including Hypertension, Diabetes, Sleep Apnea and left knee Osteoarthritis.

accused before the DDU Hospital on 4th or 5th November 2024 and counsel was directed to provide all previous history of ailments of the accused to the Jail Superintendent and to be shared with DDU Hospital. 4.
Counsel for the petitioner states that counsel who appeared for accused before the Trial Court has already supplied medical documents relating to previous medical history of accused to the Jail Superintendent on 29th October 2024.

APP for the State points out that even though no subsequent date was given by order dated 28th October 2024 by the ASJ, directions had been given, as noted above, and bail was not dismissed or disposed of. 6.
Accordingly, the matter is remanded back to the ASJ for hearing and disposing the bail petition of the accused/petitioner, in accordance with law, based on the merit of the medical documents and assessment by the DDU Hospital.

List before the ASJ on 8th November 2024.
