Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner seeking quashing of Complaint dated 03.03.2025 filed by Respondent No. 2 before CAW Cell and all the proceedings emanating therefrom as it amounts to malicious abuse of process of law.

Learned Prosecutor submits that the FIR No. 314/2025 dated 07.10.2025 under Sections 498A/406/34 IPC has already been registered against the Petitioner and at this stage, there is no question of quashing of the FIR.

Considering the submissions made, the Petition alongwith pending Applications, if disposed of with liberty to the Petitioner to join the investigation and to follow the appropriate remedy including quashing of FIR before the appropriate Forum.
