CM(M) 308/2017 & CM No.10681/2017 By the present petition under Article 227 of the Constitution of India the petitioner seeks to impugn the order dated 8.2.2017. The present matter has not been heard so far. Learned counsel appearing for the petitioner submits that the present petition is infructuous as the right of the respondent to cross-examine RW-1 Shri Chander Prakash Mehra has been closed on the last date of hearing after filing of the present petition.

Learned counsel for the respondent opposes the withdrawal of the petition on the ground that his right to cross-examine RW1 has been closed. He submits that in any case he has already filed an application before the trial court and will urge the same before the trial court. Petition is dismissed as withdrawn. All pending applications, if any, also stand disposed of accordingly.
