The present petition filed under Section 447 of the Bharatiya Nagarik Suraksha Sanhita, 20231 seeks transfer of Complaint Case No. 9293/2020 from the Court of the Metropolitan Magistrate, Patiala House Court, New Delhi to the Court of Metropolitan Magistrate, South East, Saket Courts, Delhi.

The Petitioner states that the complaint was inadvertently filed before a Court which did not have a territorial jurisdiction, as the alleged incident occurred in Defence Colony, which falls within the jurisdiction of Metropolitan Magistrate, South East, Saket Court. 3.
Respondents No. 2 and 3 are also objecting to the territorial jurisdiction of Patiala House Courts.

In light of the above, the request made by the Petitioner is justified and accordingly, the present petition is allowed with a direction that the Complaint Case No. 9293/2020 shall be transferred from the Court of the Metropolitan Magistrate, Patiala House Courts to the Court of Metropolitan Magistrate, South East, Saket Courts.

It is made clear that the Respondents challenge against the summoning order before the Revisional Court would be adjudicated on its own merits uninfluenced by the transfer of the instant petition. 6.
