Second Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Applicant seeking Regular Bail in FIR No. 0556/2024 under Sections 20/25 NDPS Act, registered at P.S.: Mahendra Park, Delhi.

It is submitted that first Bail Application bearing No.2579/2025 filed before this Court was withdrawn on 28.07.2025, with liberty to file the same at the subsequent stage.

As per the case of prosecution, on 28.10.2024, secret information was received that co-accused Rinku and Seema are involved in the supply of Ganja. On the basis of information, a raid was conducted and 05 Kg and 172 Gram Ganja was recovered from the plastic bag allegedly being carried by the co-accused persons. Co-accused Rinku and Seema, in their disclosure statements, disclosed that Applicant / Accused Sushila @ Noni was arrested on 20.05.2025 in the present case, but nothing incriminating has been recovered from her.

Co-accused Rinku has already been granted Regular Bail by Ld. Special Judge, (NDPS), Distt. North, Rohini, Delhi vide Order dated 08.04.2025.

It is submitted that there is no other incriminating evidence, except the disclosure statements of co-accused Rinku and Seema. Chargesheet and Supplementary Chargesheet have already been filed. Prayer is therefore, made that she be granted Regular Bail.

Status Report filed in the Court today be taken on record, wherein entire investigation carried out in the present case has been stated. It is further submitted that first Bail Application filed by the Petitioner before this Court was withdrawn on 28.07.2025. Earlier Bail Applications filed before learned Sessions Court were also dismissed. Submissions heard and record perused.

Admittedly, there is no recovery affected from the Applicant, who had been arrested on 20.05.2025, on the basis of disclosure statements of coaccused Rinku and Seema, from whom, recovery was affected and Rinku has also been admitted to Bail.

Considering her incarceration and that the Chargesheet and Supplementary Chargesheet have already been filed, the Petitioner/Accused is granted Regular Bail, on the following terms and conditions: The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

a) The Petitioner/Accused shall furnish a personal bond of Rs.35,000/- and one surety of the like amount, subject to the satisfaction of the learned Trial Court;

b) The Petitioner/Accused shall appear before the Court as and when the matter is taken up for hearing;

c) The Petitioner/Accused shall provide his mobile number/ changed mobile number to the IO concerned, which shall be kept in working condition at all times;

d) The Petitioner/Accused shall not indulge in any criminal activity and shall not communicate or intimidate the witnesses; and e) In case the Petitioner/Accused changes his residential address, the same shall be intimated to learned Trial Court and to the concerned I.O.

A copy of this Order be forwarded to the concerned Jail Superintendent and the learned Trial Court.
