Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner for quashing of FIR No. 0211/2025 registered under Section 308(2) BNS at P.S. Seelampur and all other proceedings emanating therefrom, in terms of the Memorandum of Settlement dated 09.09.2025.

Learned APP appearing on advance Notice, accepts the Notice on behalf of the State.

The Complainant is present in person, who submits that the Petitioner is his nephew and on the day of incident, he had some altercation and the Petitioner had abused him. However, the matter has now been amicably settled vide Memorandum of Settlement dated 09.09.2025. It is prayed that the present FIR No. 0211/2025 be quashed, in terms of the Settlement. The parties are present before this Court in-person today and have been identified by the Investigating Officer. The parties have endorsed the amicable settlement and accepted the terms thereof voluntarily and undertake not to repeat such acts in future.

The present Petition has been signed by the Petitioner and is supported by the Affidavit. The parties have reaffirmed the terms of the settlement arrived at vide Memorandum of Settlement dated 09.09.2025 and they also submit that the said Settlement has been arrived at between the parties, without any pressure and coercion.

In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion and also the fact that the present matter is related to relatives, no useful purpose will be served in continuing with the proceedings, rather the same would create further acrimony between them. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. 7.

Moreover, there is no legal impediment in quashing the FIR in question.

Accordingly, FIR No. 0211/2025 registered under Sections 308(2) BNS at P.S. Seelampur and all other proceedings emanating therefrom are quashed.
