The present application has been filed on behalf of Mr. Vinod Kumar Dhingra for clarification of the order dated 08th October, 2025, passed in the present matter.

Learned counsel appearing for the applicant submits that the applicant had filed a contempt petition against the petitioner herein and against the Municipal Corporation of Delhi ("MCD") Officials, being Cont. Cas. (C) No. 801/2022, titled as "Vinod Kumar Dhingra & Anr. Versus Deepak Mehto Junior Engineer & Ors.", for non-compliance of the order dated 28th July, 2020, passed in W.P.(C) 4614/2020, titled as "Vinod Kumar Dhingra The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

and Anr. Versus North Delhi Municipal Corporation & Ors.". 3.

It is submitted by the applicant that the unauthorized construction still exists in the property in question, details of which have been given in the present application.

Thus, the present application has been filed for clarification of the order dated 08th October, 2025 that the said order will not have effect on the proceedings on the Cont. Cas. (C) No. 801/2022. 5.

Issue notice. Notice is accepted by learned counsel appearing for the petitioner and the MCD.

Learned counsel appearing for the MCD submits that pursuant to the representation of the petitioner, hearing has already been granted to the petitioner. Further, a Speaking Order shall be passed by the Deputy Commissioner, Karol Bagh Zone, within the next few days. 7.

He further submits that requisite action shall be taken by the MCD after passing the Final Order, upon the representation of the petitioner. 8.

Having heard learned counsels for the parties, it is clarified that by way of the order dated 08th October, 2025, this Court had only granted limited protection that no coercive action be taken against the petitioner herein till final Speaking Order is passed by the Deputy Commissioner, Karol Bagh Zone, upon the representation of the petitioner. 9.

It further clarified that the MCD is free to take requisite action against the unauthorized construction, subject to any Speaking Order passed by the MCD.

Needless to state, any contempt proceeding can continue qua any action that the MCD ought to take, subject to the Speaking Order passed by the Deputy Commissioner, Karol Bagh Zone.

With the aforesaid directions, the present application stands disposed of.
