O R D E R

% 02.05.2017 CM No. 45417/2016 (by appellant for release of excess amount) This application seeks return of the excess amount deposited by the appellant. The impugned award was of Rs. 17.68 lakhs. This Court had reduced the award of compensation to Rs. 9.23 lacs with interest at the rate of 9% from the date of filing of the petition till realization. Of the amount deposited, the aforesaid reduced awarded amount shall be payable to the beneficiaries in the proportionate share mentioned in the award. The amount of Rs. 50,000/- paid under the interim award shall be adjusted against the total of the award. Therefore the four FDRs, which have been made from the amounts deposited by the appellant, shall be encashed so as to satisfy the aforesaid award and the remaining amount shall be released to the appellant. Let it be so done. The TDS amount and the statutory deposit made by the appellant too shall be released to the appellant along with interest as may have accrued thereon.

The application stands disposed off.
