This petition has been filed for quashing of FIR No.297/2020 PS Patel Nagar under Section 354A IPC and Section 10/12/14 POCSO based on a purported settlement arrived at between the parties on 30th August 2024.

However, from a perusal of the FIR and nature of allegations made by the prosecutrix, who was aged 14.5 years at the time of the alleged incident in 2020, this Court is not inclined to quash the FIR. 3.
As per the allegations, the accused had inappropriately touched the prosecutrix and made physical advancements towards her, including showing her pornography and various other incidents which are narrated in the FIR.

The prosecutrix, who is major now, is present in the Court along with her mother. that she was a young minor girl at that time and did not want to get harassed by the continuance of trial. However, considering the allegations, prosecutrix and her mother have been counselled in this regard, in order to continue with the proceedings.

Testimony of prosecutrix be recorded by the Trial Court expeditiously in accordance with Rules applicable to vulnerable victims. 6.
Though there is no allegation of petitioner influencing the prosecutrix or her family, and in the event of any such incident in future, they shall be at liberty to report the same to the IO.

Petition is dismissed and disposed of with these directions. 8.
