By way of present bail application, the applicant seeks interim bail in FIR No. 0912/2021 registered under Sections 147/148/149/302/34 IPC at P.S. Khyala on the ground that his wife has suffered a fall resulting in injuries in her lower back for which she was advised surgery at Aadhya9 Multispecialty Hospital, West Patel Nagar, New Delhi which was initially scheduled for 30.10.2024, however, she couldn't undergo the said surgery on account of custody of the applicant in the present case. 2.
Learned counsel for the applicant submits that the applicant is also involved in another case being FIR No. 51/2024 registered under Sections 3/4 of the MCOC Act at P.S. Khyala wherein he has been released on interim bail for a period of 30 days for the aforesaid reason. informed that even earlier, the applicant was released on interim bail for a period of 45 days, a concession which he did not misuse. Lastly, it is submitted that a fresh date of surgery of has now been fixed for the applicant's wife on 08.11.2024.

Ld. APP for the State, on instructions from the I.O., submits that though all the eye witnesses stand examined, the material witnesses are yet to be examined. He, on further instructions, states that the co-accused has already been released on regular bail vide order of this Court dated 21.10.2024. It is also informed that the medical documents of the applicant's wife already stand verified.

Considering the totality of the facts and circumstances, including the fact that the medical documents of the applicant's wife stand verified and that he has already been granted interim bail in FIR No.51/2024, it is directed that the applicant be released on interim bail for a period of two weeks from the date of his release, subject to him furnishing a personal bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the concerned Jail Superintendent/concerned Court/ Duty Judicial Magistrate/Link Judicial Magistrate and subject to the following conditions :- i) The applicant shall not leave the Delhi NCR without prior permission of the concerned Court;
ii) The applicant shall provide his mobile number to the I.O. which he will keep operational and remain available during the period of his release; iii) The applicant shall report to the I.O./SHO of the concerned police station on every Monday and Friday during the period of interim bail period; iv) The applicant shall not directly/indirectly try to get in touch with the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
