The applicant seeks anticipatory bail in FIR No. 798/2025 dated 10.09.2025, for commission of offences under Sections 75 (sexual harassment) and 78 (stalking) of Bharatiya Nyaya Sanhita (BNS), 2023 (corresponding Section 354A/354D IPC), registered at P.S. Burari. 2.
The allegations against the accused are to the effect that prosecutrix had come to a hospital for medical check-up and the applicant, who is Senior Consultant in such hospital, misused his position and stalked her and touched her inappropriately on the pretext of conducting medical examination. 3.
When the matter was taken up by learned Predecessor Bench on 09.10.2025, it was noticed that in view of absence of any corroborating evidence suggesting applicant's involvement, the custodial interrogation was neither necessary nor justified and subject to applicant joining investigation, BAIL APPLN. 3838/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. there was a direction to the Investigating Agency not to take any coercive steps against him.

The abovesaid order is still in operation.

No one has appeared from the side of prosecutrix. 6.
When asked, learned Addl. P.P. for the State apprised that as per instructions received from the Investigating Agency, the applicant has already joined the investigation and even charge-sheet has been filed against him, without arrest. He states that the case is already at the stage of consideration of charge.

In view of the abovesaid peculiar development and the fact that the petitioner has already joined the investigation, the interim order is made absolute. Since, the next date before the learned Trial Court is stated to be 18.02.2026, let personal bond and surety bond in a sum of Rs. 25,000/- each be submitted by the applicant before the learned Trial Court. 8.
The application stands disposed of.
