This is a petition under Section 528 BNSS, 2023, for quashing of FIR No. 80097152 dated 02.09.2024 registered under Section 305 read with Section 3(5) of BNS,2023 at e-Police Station (Hauz Khas, South District) and all the proceedings emanating therefrom.

As per the status report filed by the State, regarding the present e-FIR, Standing Order No. CRIME/26/2024 of Delhi Police provides an online system for e-FIR/e- NCR registration, specifically for property related crimes such as theft, burglary and motor vehicle theft. However, this case pertains to allegation of cheating, which according to learned APP is not eligible for registration of e-FIR registration. The status report reveals that eFIR was erroneously registered due to misapplication of provisions of e-FIR. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 01/07/2025 at 02:55:21
Consequently, e-FIR No. 80097152, registered at Police Station Hauz Khas has since been cancelled.

Learned APP appearing for the State submits that after cancellation of e-FIR, the complaint has been transferred to EOW Cell for necessary action. 4.
Mr. Akshay Chandra, learned counsel appearing for the petitioner, under instructions, states that since FIR has already been cancelled, he does not want to press the present petition for quashing the FIR and seeks permission to withdraw the same.

The statement made by learned counsel is taken on record and petition is dismissed as withdrawn.

By virtue of CRL.M.A. 14901/2025, respondent No. 2 seeks issuance of directions to State to comply with the order dated 06.11.2024 and seize black money and accounts, and to find the money trail. 7.
Respondent No. 2 is at liberty to resort appropriate legal remedies, as available under law. This application, filed by respondent No. 2 is accordingly disposed of.
