O R D E R

% 01.08.2018 Learned counsel for the petitioners submits that petitioner-Ajay Medi is husband of petitioner-Shakuntla Devi.

Ajay Medi is son of Late Smt.

Pramila Devi. During her life time, Smt. Pramila Devi had entered into an agreement to sell with complainant-Hemant Mehta in respect of sale of

property bearing no. C4F/9, Janak Puri, New Delhi. Sale consideration, as per the agreement to sell, was fixed at `1.89 crores. Petitioners had not witnessed to the said agreement to sell. Unfortunately, Smt. Pramila Devi has died. Complainant had failed to comply with his part of obligation. Learned APP, who is assisted by counsel for complainant, submits that Ajay Medi had signed the receipts as a witness. During the course of hearing, it is admitted by the parties that suit for specific performance has also been filed by the complainant against legal heirs of Late Smt. Pramila Devi including petitioner-Ajay Medi. Pursuant to the order dated 9th March, 2018, `1 crore has been deposited by the petitioners in this Court. Petitioners have already joined the investigation.

Keeping in mind totality of the facts and circumstances of this case, it is ordered that in case of arrest, petitioners be released on bail subject to their furnishing a personal bond in the sum of `50,000/- each with one surety in the like amount each to the satisfaction of Arresting Officer/Investigating Officer/SHO of the concerned police station.

Both the bail applications are disposed of in the above terms. Dasti.
