% 01.03.2017 Petitioner is aggrieved by the illegal and unauthorized construction which is being permitted to private respondent (respondent no.2) at property bearing No.A-34, Johri Far, Noor Nagar, Extension, Jania Nagar, New Delhi. It is stated that is against all the bye-laws of the Corporation.

On advance notice learned counsel appearing for respondent no.1/SDMC submits that the illegal deviations in the property stands booked on 09.2.2017. Demolition order has been passed on 20.02.2017. A work stop notice was issued on 23.02.2017. On this count learned counsel for petitioner submits that even after a work

stop notice has been given the work is still going on. The respondent is made aware to this situation. He submits that the Corporation will take all necessary actions in accordance with law. Counsel for respondent no.3 is also present. He also submits that the police will do the needful. Noting the submissions of counsels both appearing for respondent no.1 and respondent no.3 and their commitment that the initiation of this action taken by the statutory body shall be taken to its ultimate goal, this Court notes that there is nothing which really survives in this petition. Needless to state that statement made by respondent nos.1 and 3 which is in the nature of undertaking shall be honoured in true letter and spirit.

Petition disposed of.
