O R D E R

The appellant as well as respondent present in Court submit that they have amicably settled this matter with the assistance of Mr. Sanjoy Ghose, learned amicus curiae.

Learned counsel for the appellant has handed over the original memorandum of settlement along with the receipt which are taken on record. The respondent present in Court acknowledges and confirms the term of the settlement and his signatures/thumb impression on the settlement.

The settlement between the parties is taken on record. The appeal and the pending application are disposed of in terms of the settlement. Both the parties shall remain bound by the settlement. 4.

The appellant has handed over six post dates cheques for Rs.38,751/- each to the respondent as per the details mentioned in para 5 of the settlement. The appellant present in Court undertakes that all the aforesaid cheques shall be honoured on their first presentation. The undertaking of the

appellant is hereby accepted.

The appellant has deposited Rs.1,22,498/- with the Commissioner, Employees' Compensation. The Commissioner, Employees' Compensation is directed to release the aforesaid amount to the respondent along with interest accrued thereon within a period of three weeks from today. 6.

The record of the Commissioner, Employees' Compensation along with the copy of this order be sent back to enable the Commissioner, Employees' Compensation for releasing the amount deposited by the appellant.

This Court appreciates the assistance rendered by learned amicus curiae in this matter.

Copy of this order be given dasti to counsels for the parties under signature of Court Master.
