Petitioner/plaintiff has assailed order dated 21.08.2025 of the learned trial court, whereby subject to the petitioner/plaintiff depositing costs of Rs.25,000/- with Prime Minister's National Relief Fund, last and final opportunity to conclude plaintiff's evidence on 13.10.2025 was granted. 2.
It being an issue of cost, notice of this petition is not required to be issued to the other side.

Learned counsel for petitioner/plaintiff in all fairness concedes that the petitioner/plaintiff ought to have been diligent and assures that henceforth, there shall be no lack of diligence on the part of the petitioner/plaintiff.

After addressing partly, learned counsel for petitioner/plaintiff on instructions seeks permission to withdraw this petition with the request for reducing the cost.

Accordingly, the petition and the accompanying application are disposed of as withdrawn, reducing the amount of cost of Rs.25,000/- to Rs.10,000/-. It is made clear that if evidence is not concluded by the petitioner/plaintiff on 13.10.2025 as fixed by the trial court, no further indulgence shall be granted.
