This petition is filed on behalf of the Petitioner under Section 11(6) of the Arbitration and Conciliation Act, 1996 seeking appointment of the Sole Arbitrator to adjudicate the disputes between the parties arising from Acceptance Letter dated 31.12.2018 pertaining to work of construction of additional SPS Classrooms in different schools alongwith other works of water supply, sanitary installation etc. at SKV Sultanpuri Road, Nangloi, Delhi.

Ms. Nitika Bhutani, learned counsel accepts notice on behalf of the Respondent and on instructions, does not dispute the existence of the arbitration agreement albeit claims of the petitioner are disputed on merits. Learned counsel for the Petitioner submits that as per Clause 25 of GCC, disputes have to be referred for adjudication to a Sole Arbitrator who must be a Graduate Engineer and therefore, the Arbitrator be appointed from the panel of Arbitrators maintained by CPWD/PWD. 5.

As the existence of the Arbitration Agreement is not disputed, whereby parties agreed to refer the disputes to arbitration, this petition is allowed appointing Mr. Akhilesh Kumar, Retd. SDG, CPWD (Mobile No. 9811420440) as the Sole Arbitrator to adjudicate the disputes between the parties. Arbitration proceedings will be held under the aegis of Delhi International Arbitration Centre (DIAC) and as per its Rules. Fee of the Arbitrator shall be as per the DIAC (Administrative Cost and Arbitrators' Fees) Rules, 2018.

Learned Arbitrator shall give disclosure under Section 12 of the 1996 Act before entering upon reference.

It is made clear that this Court has not expressed any opinion on the merits of the case and all rights and contentions of the respective parties are left open.
