W.P.(CRL) 3451/2024 The present petition has been filed seeking grant of parole for a period of eight weeks in case FIR No. 569/2000 under Section 364A/34 IPC registered at PS Preet Vihar.

Learned counsel for the petitioner submits that the petitioner is seeking grant of parole on the ground of death of his real brother namely Rakesh Kumar, who died on 28.10.2024. Learned counsel submits that his Tehrvi is scheduled for 08.11.2024 and Shudhi Pooja is fixed for 28.11.2024.

Issue notice.

Learned SC for the State has accepted the notice and has very fairly submitted that they have verified the factum of the death. Learned SC submits that without going into the merits of the case and in view of the exceptional circumstances anddespite the fact that there are other male members of the family, the petitioner may be released on parole for one week from the date of his release to attend the Tehrvi scheduled for 08.11.2024.

Learned counsel for the petitioner submits that given the above, he does not want to press the present petition.

Let the petitioner be released on parole for one week from the date of his release to attend the Thrive of his brother scheduled for 08.11.2024 as per law on furnishing a personal bond of Rs. 5,000/- with one surety of the like amount before the concerned Jail Superintendent. Copy of this order be sent to the concerned Jail Superintendent for necessary compliance and information.
