A Petition under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 read with Section 482 Cr.P.C has been filed on behalf of the Petitioner seeking quashing of Summoning Order dated 10.11.2023 of learned Judicial Magistrate, New Delhi.

First and the foremost it is a Summoning Order dated 10.11.2023 and the present Petition has been filed to challenge the Summoning Order after a period of about two years. There is no explanation for the delay in filing the present Petition.

before the Court of learned ASJ. There being an equally efficacious remedy available with the Petitioner, the Petition is disposed of with liberty to the Petitioner to approach the Court of Sessions, in accordance with law. 6.
