% 17.12.2024 1.

This is a petition seeking regular bail in FIR No. 181/2023 under Sections 370/376/34 IPC and 5/6 IT(P) Act and Section 6/17 of the POCSO Act registered at PS Neb Sarai, Delhi.

2.

The FIR is predicated on the statement of the complainant who states that she was working for the petitioner and thereafter the petitioner introduced her into prostitution.

3.

It is further stated that the petitioner was introducing clients to the complainant and thereafter taking money.

4.

The complainant was then tested for pregnancy and it was found that she was pregnant. As per the averments in the petition, the pregnancy was through the son of the petitioner. The pregnancy was subsequently aborted. 5.

The complainant has duly supported her case in the statement The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 30/12/2024 at 11:52:30

recorded under Section 164 Cr.P.C., however the testimony of the complainant seems to suggest that she has turned hostile and has not supported her statement recorded under Section 164 Cr.P.C. 6.

On the other hand, similar FIR was also filed by another victim namely G and in the statement under Section 164 Cr.P.C. as well her evidence, G has fully supported the case against the petitioner. 7.

It is also stated that the testimony of the victim G also mentions the petitioner herein.

8.

At this stage, I am informed that the evidence of the prosecution is over and the matter is now fixed for recording the statement of the accused. 9.

The charges against the petitioner/accused are grave and under POCSO. One of the witnesses has supported the case of the prosecution. The evidence of the prosecution is over. In these circumstances, I am not inclined to entertain the petition.

10.

Hence, the petition is disposed of requesting the Trial Court to conclude the evidence and dispose of the matter as expeditiously as possible.
