The Petitions under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as „B.N.S.S.‟) (erstwhile Section 482 of the Code of Criminal Procedure, 1973) have been filed on behalf of the Petitioners, to challenge the Order of Summoning dated 06.09.2025 whereby the Petitioners have been summoned for the offence under Section 255/260 of the Bharatiya Nyaya Sanhita, 2023 (erstwhile Section 217/221 of the Indian Penal Code, 1860). Essentially, it is a Summoning Order, which has been challenged, for which there is an alternate efficacious remedy towards the Court of Sessions.

Learned counsel for the Petitioners, submits that the matters are listed before the learned JMFC on 15.10.2025 and sometime/protection may be given to enable the Petitioners, to file the appropriate Petitions before the Court of Sessions.
