The petitioner is seeking initiation of contempt proceedings against the respondent/MCD for the alleged willful disobedience of the directions contained in the order dated 06.05.2024 in W.P.(C) No. 6383/2024, passed by this Court.

Learned counsel for respondent/MCD is present on advance notice.

It appears that the petitioner is aggrieved by the alleged unauthorized constructions in the subject property. since been rejected by the MCD and yet no demolition action has been taken.

Learned counsel for respondent/MCD, however, submits that a Show Cause Notice has been issued to the occupier/builder on 23.09.2024 and the hearing is going to take place on 08.11.2024 with regard to the unauthorized constructions in the subject property and it is assured that the appropriate action would be taken in accordance with the law.

That being the matter, the present contempt petition does not survive, and hence, the same is dismissed without prejudice. DHARMESH SHARMA, J.
