The present writ petition has been filed seeking directions to respondent nos. 1 to 3, to take necessary action against the respondent no.4, thereby, restraining him from undertaking any construction/renovation work contrary to the family settlement at the property No. 76 (Right Portion), Masjid Lane, Jangpura, Bhogal, New Delhi-110014. 2.

Learned counsel appearing for the petitioner has drawn the attention of this Court to the photographs attached with the present petition to submit that the water tanks of respondent no. 4 leak, due to which, water gets accumulated on the terrace. At this stage, learned counsel appearing for respondent no.4 submits that only whitewash was being done on account of approaching festival season. However, it is submitted that no construction is being undertaken by respondent no.4 currently.

Noting the submissions made by learned counsels appearing for the parties, respondent no.4 is directed to ensure that there is no water seepage or overflowing of the water from the water tank installed by respondent no. 4.

The property shall be maintained properly and in a good condition by respondent no. 4, as well as the petitioner, so that both the parties, i.e., the petitioner and respondent no.4, who are real brothers, live peacefully without hindering each other's living conditions. 6.

With the aforesaid directions, the present writ petition, along with the pending application, stands disposed of.
