% 03.03.2016 Mr. Sanjay Jam, learned Additional Solicitor General has handed over today in Court letter dated 2nd March, 2016, which is kept on record. In the terms of the said letter, learned Additional Solicitor General seeks permission to withdraw the present writ petition as it is rendered infructuous.
Learned Additional Solicitor General states that in view of the said position, the Court may be pleased to issue appropriate directions as the Director General, Narcotics Control Bureau West has been directed to appear before the Central Administrative Tribunal today. We may record that this writ petition was listed yesterday and after some hearing, Mr. Jam had prayed for time to obtain instructions. We had adjourned the matter for today, noticing the fact that the Tribunal had directed personal presence of the Director General, Narcotics Control Bureau West.
In view of the letter filed on record today, which will be also filed before the Tribunal, we observe that the Tribunal may not insist on personal presence of the Director General, Narcotics Control Bureau West, on an application being moved by the petitioner before the Tribunal.
V With the aforesaid observations, the writ petition is dismissed as withdrawn.
