The present petition has been filed seeking following relief: "a) a writ of mandamus or any other appropriate writ/order be issued to the respondent directing not to transfer the leasehold rights in the property bearing Plot No. 251, admeasuring 32 Sq. Mfrs. (40 Sq. Yds.), Pocket-1 JB, Sector-23, situated in the layout plan of Rohini Residential Scheme, Rohini, Delhi-110085, to anyone other person other than the petitioner."

At the outset, Mr. R.K. Dhawan, learned Standing counsel appearing on behalf of respondent/DDA on advance notice, submits that the present case involves disputed question of facts.

He invites attention of the Court to Annexure-P/16, to contend that the FIR has been registered at the instance of one Mr. Prashant alleging forgery with regard to the documents pertaining to property in question. He submits that an application was filed by the petitioner for release of documents on superdari, however, the said application was dismissed vide order dated 09.06.2025.

Faced with this situation, Mr. H.S. Sharma, learned counsel appearing on behalf of petitioner seeks to withdraw the present petition with liberty to approach the Civil Court.

The petition along with pending applications is dismissed as withdrawn with liberty as aforesaid.
