% 09.03.2018 Crl.M.A.4439/2018 (exemption) Exemption is allowed subject to all just exceptions. CRL.M.C. 1212/2018 1.

The petitioners seek quashing of FIR No.198/2014 under Sections 354-A/354/323/34 IPC, Police Station Vivek Vihar. Subsequently, on filing of the chargesheet, charge has been framed under Sections 354 and 323 IPC against the petitioner No.1 and under Section 354-A IPC against the petitioner No.2.

It is contended that the parties are also distantly related to each other. It is contended that because of a misunderstanding, the subject incident happened.

Parties have settled their disputes through the CRL.M.C. 1212/2018

intervention of family members and respectable people of the locality and a Compromise Deed dated 02.01.2018 has been executed. 3.

Respondent Nos.2 is present in Court in person and is identified by the Investigating Officer. She submits that she has settled the disputes with the intervention of family members and respectable people of the locality. She further submits that she does not wish to press the criminal complaints against the petitioners.

In view of the fact that parties are distantly related to each other and the disputes between the parties have been settled and a Compromise Deed dated 02.01.2018 has been executed between the parties, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored in the family; securing the ends of justice being the ultimate guiding factor. It would also be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.

In view of the above, the petition is allowed. FIR No.198/2014 under Sections 354-A/354/323/34 IPC, Police Station Vivek Vihar and the consequent proceedings emanating therefrom are, accordingly quashed, 6.
