OMP (ENF.) (COMM.) 28/2017 & IA No.2815/2017 The learned counsel for the petitioner states that a petition under Section 34 of the Arbitration and Conciliation Act, 1996 has been filed albeit belatedly and is not maintainable. However, without prejudice to the rights and contentions of the petitioner, she seeks to withdraw the present petition with liberty to file afresh subject to the outcome of the said petition (ARBT.1298/2016).

The learned counsel for the petitioner states that a petition under Section 34 (ARBT.1298/2016) is now listed for hearing on 17.05.2016 on the issue of condonation of delay.

It is expected that the Court shall consider and dispose of the said petition as expeditiously as possible and

preferably on that date.
