% 10.07.2017 The petitioner has filed this writ petition under Article 226 of the Constitution of India for quashing of FIR No.0148/2014 dated 30th October, 2014 registered with Police Station CAW Cell, Nanakpura, New Delhi, under Sections 406/498A/34 of IPC.
Learned Additional Standing Counsel through IO SI Gajender Singh submits that charge-sheet has already been filed against the petitioners No.1 and 3 and that the petitioners No.2 and 4 have been kept in Column No.12. It is further submitted that since the petitioners No.1 & 3 have so far not appeared, the Court of Ms.Richa Gosain, learned MM, South West District, Dwarka, has ordered issuance of non-bailable warrants. Learned counsel for the petitioners, on instructions, submits that he does not want to pursue the present petition but he be granted liberty to raise all the pleas as taken in the present petition before the learned MM. He also
submits that since the petitioners No.1 and 3 are residing in Melbourne, Australia, he would be moving necessary application before the trial court for surrender/bail.
The petition is dismissed as withdrawn with liberty as prayed for. VINOD GOEL, J.
