O R D E R

% 13.09.2025 Appellant insurance company has filed an appeal for reduction of the award dated 23.12.2017 passed by the Learned MACT, awarding a compensation of Rs. 12,51,497/- along with interest @ 9% p.a. from the date of filing of claim petition.

On appeal, the insurance company deposited Rs. 8,00,000/- along with the interest @ 9% per annum from the date of claim petition till the date of deposit in terms of Order dated 12.03.2018 and balance amount along with interest was directed to be deposited vide order dated 27.04.2018.

We find that the Insurance Company has deposited Rs. 29,42,561/- with the Registrar General of this Hon'ble Hgih Court in terms of orders dated 12.03.2018 and 27.04.2018. We also find that the this Hon'ble High Court vide order dated 29.05.2018 has directed that the balance amount, after keeping Rs. 25,20,00/- in FDRs be released to R-1 & 2 in equal shares by transferring the same to their savings bank accounts with Union Bank of India, Kaushambi, Ghaziabad.

We have interacted with the learned counsel for the appellant/Respondent, it is agreed between the parties that out of the balance amount remaining deposited before the Registrar General of this Hon'ble High Court, lump sum amount of Rs. 2,00,000/- be refunded to Insurance Company and rest of the amount along with total interest shall to R-1 & 2 in equal shares.

In view of the above, we direct the lump sum amount of Rs. 2,00,000/- be refunded to the Insurance Company and balance amount lying deposited with the Registrar General of this Hon'ble High Court along with the total interest in terms of settlement be released to the R-1 & 2 as per the proportions of the award after fulfillment of the requisite formalities.

Needless to say that the appellant shall be entitled to refund of the statutory amount along with interest, if any and accordingly, Ld. Registrar General is directed to refund the same to the Insurance Company.

In terms of the aforesaid, the present appeal along with pending application(s) stand disposed of with directions with in terms of settlement.
