One of the objections raised by learned counsel for the respondent is that a petition under Section 8 is pending before NCLT as well as nonissuance of a prior notice under Section 21 of the Arbitration & Conciliation Act, 1996, before invoking arbitration.

At this stage, learned Senior Counsel for the petitioner seeks leave to withdraw the instant petition and to take requisite steps for it to approach this Court again.

Leave and liberty as prayed for is granted. The petition is dismissed as withdrawn.
